The Promotion of Access to Information Act (PAIA) gives you the right to ask for records held by a private body. This manual explains what records we hold, how to ask for them, and what happens next. It is required by section 51 of PAIA.
It is separate from our Privacy Policy, which explains how we handle personal information under POPIA. If you want to know what we hold about you, either route works, and the Privacy Policy route is usually quicker.

Not all of these are automatically available. See section 6 on grounds for refusal.

Records are also kept under legislation including the Companies Act 71 of 2008, the Tax Administration Act 28 of 2011, the Income Tax Act 58 of 1962, the Value-Added Tax Act 89 of 1991, the Basic Conditions of Employment Act 75 of 1997, the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 and POPIA.
If you simply want to see, correct or delete the personal information we hold about you, you do not need Form 2. Email the address in section 2 and say so. That is a POPIA request and it is handled free of charge.
We will respond within 30 days of receiving a valid request. That period may be extended by up to a further 30 days where the request covers a large number of records or requires a search through records held elsewhere; we will tell you in writing if that happens, and why.
PAIA obliges us to refuse in some cases and permits it in others. The main grounds:
Section 70 provides a public-interest override: we must release a record despite most of the above where disclosure would reveal a substantial contravention of the law or an imminent and serious public safety or environmental risk, and the public interest in disclosure clearly outweighs the harm.
If we refuse, we will tell you in writing, give reasons, and explain how to appeal.
Two fees may apply, both set by regulation under PAIA:

We will tell you the amount before doing the work, and we may require a deposit where preparation is expected to take longer than the prescribed threshold. Current prescribed amounts are published by the Information Regulator; we apply those rates and do not add a mark-up. Fees may be waived where the regulations allow.
You may complain to the Information Regulator using the details in section 3, or apply to a court. A complaint to the Regulator costs nothing.
If you submitted an enquiry, your details were also sent to Homegrown Brokers, who hold their own records and have their own PAIA manual and privacy practices. Requests about what they hold must be made to them directly.
